1. About Us and These Terms

1.1 These Terms and Conditions ("Terms") govern the agreement between Szabina T. Wagner, sole trader trading as CBT Sound Therapy ("we", "us", "our"), and any person who uses or books our services ("you", "your", "client").

1.2 We are a sole trader operating in England. Our contact address is 36 Guernsey Close, Popley, Basingstoke, RG24 9PS, United Kingdom. Email: info@cbtsoundtherapy.com. ICO Registration Number: ZB353017.

1.3 By booking a session or otherwise using our services, you agree to be bound by these Terms. Please read them carefully before proceeding.

1.4 These Terms do not affect your statutory rights as a consumer under UK law, including your rights under the Consumer Rights Act 2015 and the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013.

2. Our Services

2.1 CBT Sound Therapy provides Cognitive Behavioural Therapy (CBT)-based sound therapy sessions intended to support adults experiencing audiological and related conditions, including tinnitus, misophonia, and hyperacusis.

2.2 Sessions are offered on an individual, one-to-one basis and may be conducted in person or online via Google Meet, depending on your preference and location.

2.3 Our services are available to residents of the United Kingdom only. Whilst our website may be accessible from other countries, we do not offer our therapy services to clients based outside the United Kingdom, and no contract is formed with any person residing outside the United Kingdom.

2.4 We provide our services as individual sessions, charged and paid for on a session-by-session basis.

3. Important Medical Disclaimer

PLEASE READ THIS SECTION CAREFULLY BEFORE BOOKING.

CBT Sound Therapy is a complementary therapeutic support service. It is not a medical service, does not constitute medical treatment or medical diagnosis, and does not replace the advice, care, or treatment of any regulated healthcare professional, including your GP, audiologist, psychiatrist, or clinical psychologist.

Regulatory status: Szabina T. Wagner is a voluntary member of the British Association for Counselling and Psychotherapy (BACP), membership no. 393111. BACP is a voluntary professional membership body and is not a statutory regulator under UK law. This service is not regulated by the Care Quality Commission (CQC) or any other statutory healthcare regulator.

Our services are not suitable as a primary or standalone response to: acute mental health crises, active suicidal ideation, psychosis, acute psychiatric emergencies, or any condition requiring immediate clinical intervention.

If you are in crisis or require urgent support, please contact one of the following immediately:

  • NHS 111 (urgent but non-emergency medical care): 111
  • Your GP or mental health crisis team

Engaging with our services does not constitute entry into a clinical or medical relationship. We shall not be liable for any harm arising from your reliance on our services as a substitute for appropriate medical, psychiatric, or emergency care.

4. Eligibility

4.1 Our services are available to adults aged 18 years and over only. By booking a session, you confirm that you are 18 years of age or older.

4.2 We reserve the right, at our reasonable professional discretion, to decline to provide services or to discontinue services where we have reasonable grounds to believe that our services are not suitable for your needs, or where doing so is necessary to protect your welfare or the welfare of others. Where we decline or discontinue services, we will explain our reasons to you and, where appropriate, signpost you towards more suitable support.

5. Booking and Appointments

5.1 Sessions may be booked through our online scheduling platform (cal.eu) or by direct arrangement via email.

5.2 A booking is confirmed once you receive a written confirmation from our scheduling system or from us by email.

5.3 You are responsible for ensuring that the contact details you provide at the time of booking are accurate and up to date. We will use these details to confirm your appointment and to contact you if we need to reschedule.

5.4 For online sessions via Google Meet: it is your responsibility to ensure you have a stable internet connection and access to a private, safe, and uninterrupted environment for the full duration of the session. Please test your connection in advance of your appointment.

5.5 If we need to cancel or reschedule your session due to illness, emergency, or other circumstances beyond our reasonable control, we will notify you as soon as practicable and offer you an alternative appointment at no additional cost to you. We shall not be liable to you for any loss or inconvenience arising from such cancellation beyond the rescheduling of your session.

6. Your Right to Cancel (Consumer Contracts Regulations 2013)

6.1 Where you book a session via our website or by email — that is, where no simultaneous in-person interaction takes place at the point of booking — your booking constitutes a distance contract to which the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations 2013 apply.

6.2 In such cases, you have the right to cancel your booking without charge within 14 calendar days of the date on which the booking was confirmed (the "cancellation period"). To cancel within this period, please contact us at info@cbtsoundtherapy.com. Cancellation within the cancellation period, and before the session has taken place, will entitle you to a full refund of any fees paid.

6.3 Waiver of the cancellation right for sessions taking place within 14 days. Because individual sessions almost always take place within 14 days of booking, we will ask you at the point of making your booking to expressly request that your session begin before the end of the cancellation period. The specific acknowledgement you will be asked to provide is:

"I request that my therapy session begins before the end of the 14-day cancellation period. I acknowledge that, once the session has been fully provided, I will lose my statutory right to cancel that booking."

6.4 If you provide this acknowledgement and the session is subsequently fully completed, you will not be entitled to a refund for that session under Regulation 36 of the Consumer Contracts Regulations 2013.

6.5 If you provide this acknowledgement but subsequently cancel your booking with more than 24 hours' notice before the session (in accordance with Clause 7.3), no cancellation fee will apply and no payment will be due.

6.6 If you book a session in person — for example, at the conclusion of a previous session whilst physically present with us — that booking is not a distance contract, and the 14-day cooling-off right described in this clause does not apply.

7. Fees, Payment, and Late Cancellation

7.1 Session fees. Our current session fees are as stated on our website at the time of booking. We reserve the right to update our fees at any time, provided that any change to fees will not apply to sessions already booked and confirmed.

7.2 Payment. Payment is accepted by card or bank transfer, due at the time your session takes place.

7.3 Late cancellation. If you cancel or request to reschedule a session with less than 24 hours' notice before the scheduled appointment time, the full session fee will be payable. This policy reflects the fact that late cancellations prevent us from allocating that appointment time to other clients.

7.4 Non-attendance without notice. If you do not attend a confirmed session without giving any prior notice, the full session fee will be payable.

7.5 Collection of late cancellation fees. As payment is by cash, any late cancellation or non-attendance fee will be due at your next attended session, or by such other written arrangement as we may agree with you.

7.6 Our cancellation. Where we cancel your appointment in accordance with Clause 5.5, no fee will be charged or payable for that session.

8. Our Liability to You

8.1 Nothing in these Terms limits or excludes our liability for:

(a) death or personal injury caused by our negligence or that of our employees or agents; (b) fraud or fraudulent misrepresentation; or (c) any other matter for which it is unlawful under the Consumer Rights Act 2015, the Unfair Contract Terms Act 1977, or any other applicable statute to exclude or limit liability.

8.2 Subject to Clause 8.1, our total liability to you arising out of or in connection with our services shall not exceed the total session fees paid by you for the session or sessions directly giving rise to the claim.

8.3 Subject to Clause 8.1, we shall not be liable for any indirect, consequential, or economic loss or damage, loss of earnings, or loss of opportunity arising from your use of or reliance upon our services.

8.4 We provide our services with reasonable care and skill, consistent with our professional training, experience, and BACP membership obligations.

8.5 We do not accept liability for any deterioration in, or failure to improve, a client's condition, given that therapeutic outcomes cannot be guaranteed and depend upon a range of personal, clinical, and circumstantial factors.

9. Your Responsibilities as a Client

9.1 You agree to engage with the therapeutic process honestly and in good faith.

9.2 You agree to inform us promptly of any material changes to your health, mental health, medication, or personal circumstances that may be relevant to your therapy.

9.3 You agree not to attend sessions under the influence of alcohol or unprescribed substances.

9.4 You acknowledge that progress in therapy cannot be guaranteed, and that outcomes depend in part on your own engagement, honesty, and commitment to the process.

9.5 You agree to treat us with courtesy and respect. We reserve the right to terminate the therapeutic relationship where your conduct is abusive, threatening, or otherwise unreasonable.

10. Confidentiality and Professional Obligations

10.1 All information shared within the therapeutic relationship is treated as strictly confidential. We adhere to the BACP Ethical Framework for the Counselling Professions (available at bacp.co.uk).

10.2 Confidentiality may be broken, and relevant information disclosed to appropriate third parties, only in the following limited circumstances:

(a) where we are required to do so by a court order or other legal obligation; (b) where we have reasonable grounds to believe there is a serious and imminent risk of harm to you or to another identifiable person; or (c) in connection with our clinical supervision obligations, as disclosed in your therapy consent form.

10.3 Where it is safe and appropriate to do so, we will discuss any intention to break confidentiality with you before doing so.

11. Intellectual Property

11.1 All materials, written resources, handouts, audio materials, and other content provided to you in the course of therapy are the intellectual property of CBT Sound Therapy or are used by us under licence. You may use these materials for your own personal therapeutic purposes only. You may not reproduce, share publicly, distribute, or commercialise them without our prior written consent.

12. Privacy

12.1 Our Privacy Policy governs how we collect, use, and protect your personal data. It is available in full at www.cbtsoundtherapy.com/privacy. By using our services, you confirm that you have read and understood our Privacy Policy.

13. Complaints

13.1 If you are dissatisfied with any aspect of our services, we encourage you to contact us in the first instance at info@cbtsoundtherapy.com. We will acknowledge your concern promptly and do our best to resolve the matter informally.

13.2 If you remain dissatisfied following our response, you may raise a formal complaint about our professional conduct with the British Association for Counselling and Psychotherapy (BACP):

13.3 Please note that we are not subscribed to an approved Alternative Dispute Resolution scheme under the Alternative Dispute Resolution for Consumer Disputes Regulations 2015. The BACP Professional Conduct Procedure referred to in Clause 13.2 provides a route to address complaints about our professional practice and standards of conduct.

13.4 Nothing in this clause affects your right to bring proceedings before a court of competent jurisdiction in accordance with Clause 14.

14. Governing Law and Jurisdiction

14.1 These Terms, and any dispute or claim arising out of or in connection with them or their subject matter or formation, shall be governed by and construed in accordance with the law of England and Wales.

14.2 The courts of England and Wales shall have non-exclusive jurisdiction to settle any dispute or claim arising in connection with these Terms. Nothing in this clause restricts your right, as a consumer, to bring proceedings before the courts of the jurisdiction in which you are habitually resident, where applicable.

15. Changes to These Terms

15.1 We may update these Terms from time to time, for example to reflect changes in our services, pricing, or applicable law. Any revised Terms will be published on our website with an updated "last updated" date.

15.2 Where we make material changes, we will take reasonable steps to bring this to the attention of existing clients. Continued use of our services following publication of revised Terms constitutes acceptance of those Terms.
